1. The Core Commitment
SpicyGen is built strictly for consensual, adult fantasy content. We believe deeply in creative freedom and the exploration of imagination. However, this freedom is built on a foundation of respect and consent.
SpicyGen maintains a strict, zero-tolerance policy for abuse, non-consensual imagery, and illegal content. Our platform is designed to empower creators while actively preventing the generation of harmful material.
In short: we do not allow sexual content of anyone under 18 or anyone who appears to be under 18. We do not allow sexual content of real people without their consent. Automated checks look for apparent minors in every uploaded photo and in every image and video we generate, and hash matching refuses exact copies of images on our block lists. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC). Anyone can ask us to remove content, without an account, using our report form.
2. Zero-Tolerance Prohibitions
The following content is strictly prohibited on SpicyGen. Attempts to generate, upload, or share this material are refused, logged, and can lead to action against the account.
- •Non-Consensual Intimate Imagery (NCII): Content depicting real individuals without their explicit, documented consent.
- •Deepfakes & Impersonation: Content that depicts or imitates a real, identifiable person (a public figure, politician, celebrity, or private individual) without their consent.
- •Child Sexual Abuse Material (CSAM): Any content depicting, implying, or referencing minors in sexual situations.
- •Illegal Acts & Violence: Content promoting, depicting, or inciting violence, self-harm, or illegal activities.
Enforcement: depending on the violation, we refuse the request, warn the user, or suspend the account. A suspension can remove the account's remaining credits without a refund. Accounts suspended for child sexual abuse material are closed permanently.
3. Moderation & Technology
We use several layers of checks. They run when a photo is uploaded, before a generation starts, and on every result before it is delivered.
Prompt Filtering
Every prompt is checked before generation: deny-lists, contextual rules, and an AI screen that looks for minors, real people (named or described), non-consent, and other prohibited themes. Prompts are checked again after our system rewrites them for the model.
Upload and Output Checks
Uploading a photo requires an account. Each upload is checked against hash lists (NCMEC Take It Down hashes we hold and images we have banned, exact copies only) and against faces registered through TAKE IT DOWN requests. Three age readings are taken (AI models from Alibaba Cloud and AWS Rekognition), and the photo is refused if they suggest anyone in it may be under 18. The photo is then described in text and a new image is drawn from that description; the photo itself is not animated or edited into the output. Every generated image and video gets an AI age check before delivery and is withheld if anyone in it appears to be under 18.
Manual Review
Our staff handle abuse reports and appeals, and can review any automated decision in our moderation logs.
4. Report Abuse & Takedowns
If you believe your likeness has been used without your consent, or if you have encountered content that violates our policies, you can report it using our form. You do not need an account.
Reports of Non-Consensual Intimate Imagery (NCII) and AI-generated intimate forgeries are prioritised for review under the 48-hour SLA below. Substantiated reports result in removal of the reported asset.
TAKE IT DOWN Act (47 U.S.C. § 223a), 48-Hour Removal
SpicyGen.ai is a covered platform under the federal TAKE IT DOWN Act (Public Law 119-12) and maintains the statutory notice-and-removal process required by Section 3. Upon receiving a valid request from an identifiable individual (or an authorized representative), we will remove the reported non-consensual intimate visual depiction or digital forgery (deepfake) and make reasonable efforts to identify and remove known identical copies within 48 hours. Submit a TAKE IT DOWN Act notice using our dedicated form: Report Content / Request Removal.
Non-DMCA Complaint or Content Removal Request
For questionable material, privacy concerns, impersonation, or general content removal requests, use our dedicated reporting form: Report Content / Request Removal (Non-DMCA). We process valid TAKE IT DOWN Act requests (NCII/Deepfakes) within 48 hours. For other general complaints, we aim to respond to the requestor within 5 business days.
A valid TAKE IT DOWN Act notice must include:
- An electronic or physical signature of the requestor (your full name typed into the form).
- Identification of, and information reasonably sufficient to locate, the depiction (the URL or exact Image/Video ID).
- A good-faith statement that the depiction is not consensual and was published without consent.
- Contact information sufficient for SpicyGen.ai to reach the requestor (a working email address).
DMCA Copyright Takedown
Submit a notice under 17 U.S.C. § 512 via our dedicated DMCA form. You may also email contact@spicygen.ai with [important] [dmca] in the subject line.
Law Enforcement: For law enforcement inquiries and official preservation requests, please contact us directly at contact@spicygen.ai from an official agency email address. All our contact points are listed on our Legal notices and contacts page.
5. Regulatory Compliance
5.1 NCMEC CyberTipline Reporting
SpicyGen.ai reports apparent child sexual abuse material to the NCMEC CyberTipline (18 U.S.C. § 2258A) and keeps the reported material and related account data.
5.2 Hash Matching
Uploaded files are checked against the NCMEC Take It Down hashes we hold and against our own list of banned images. These checks match exact copies of a file only: an edited, cropped, or re-saved copy may not match, so hash matching is one layer among several, not a guarantee.
5.3 Enforcement
Content our checks flag as possible child sexual abuse material (CSAM) is blocked. In one narrow case, a very high-confidence classifier result on an image submitted for generation, our system automatically stores the image in a restricted evidence store, files a CyberTipline report, and suspends the account. Other flags, including photos refused because someone in them may be under 18, are logged, and our staff can review them and file a report. When a second check confirms that an uploaded photo appears to show someone under 16, the account receives a warning the first time and is suspended the next time. Accounts suspended for CSAM are closed permanently, and new sign-ups with the same email address, Discord account, or Telegram account are blocked.
5.4 Cooperation with Acquirers, Processors, and Card Networks
SpicyGen.ai cooperates in good faith with lawful requests, audits, and compliance reviews from our acquiring bank, payment processors, and card networks (including Visa and Mastercard). On request, we provide moderation evidence, content-removal records, complaint-response logs, and other documentation reasonably required to demonstrate compliance with card-network rules (including Mastercard AN5196 and equivalent Visa standards) and applicable law.
