AI Policy

1. Introduction

SpicyGen AI ("we," "our," or "us") uses artificial intelligence technologies to provide our video and image generation services. This AI Policy explains how our AI systems function, the safeguards we have in place, the limitations of our technology, and your rights as a user. This policy is provided in compliance with applicable laws, including the EU AI Act and guidance from relevant data protection authorities.

2. How Our AI Systems Work

Our Service uses third-party AI models to generate short videos from user-supplied images and text prompts. The process involves:

  • Receiving an image and a descriptive text prompt from the user.
  • Processing that input through a generative AI model to produce a video output.
  • Returning the generated video to the user within their account.

Generated outputs are created automatically and do not reflect the opinions, views, or endorsements of SpicyGen AI.

3. AI Content Moderation

We use automated AI systems to moderate content uploaded to and generated by our platform. These systems are designed to:

  • Detect and block images that may depict real individuals, minors, or public figures.
  • Identify content that appears to be photography rather than AI-generated imagery.
  • Flag content that may constitute non-consensual intimate imagery (NCII) or child sexual abuse material (CSAM).
  • Assign an AI-generated confidence score to uploaded images to verify compliance with our content rules.
  • Detect deepfakes, synthetic impersonations, or realistic likenesses of real persons.
  • Identify content depicting, promoting, or inciting violence, self-harm, or illegal acts.
  • Screen for known copyright indicators such as watermarks or professional photography signatures.

Moderation decisions are made automatically but may be reviewed by our human trust and safety team where required. If your content is rejected, you may contact us at support@spicygen.ai to request a review.

4. Prohibited AI Uses

You must not use our AI systems to:

  • Generate content depicting real identifiable individuals without their explicit documented consent.
  • Create deepfakes, synthetic media, or impersonations of any person (public or private).
  • Generate or attempt to generate any content depicting minors in sexual situations.
  • Produce content intended to harass, defame, or harm any individual.
  • Attempt to circumvent or manipulate our moderation systems through prompt engineering or image manipulation.
  • Use outputs for disinformation, fraud, or any illegal purpose.

Violations will result in immediate account termination and, where required by law, reporting to relevant authorities including the National Center for Missing & Exploited Children (NCMEC).

5. Limitations of AI-Generated Content

AI-generated content has inherent limitations and unpredictability. We do not guarantee that outputs will:

  • Meet your specific expectations or creative requirements.
  • Be accurate, complete, or free from artefacts.
  • Be consistent across multiple generations from similar inputs.

Credits used for generation are consumed regardless of whether the output meets your expectations, due to the immediate computational costs incurred. Please refer to our Refund Policy for information on dispute resolution.

6. AI and Personal Data

When you upload an image, it is processed by our AI systems. Uploaded images may contain biometric data (facial features). We process this data solely to:

  • Generate the requested video output.
  • Screen for prohibited content (e.g., real persons, minors).

7. Transparency and Human Oversight

In accordance with the EU AI Act and best-practice AI governance principles:

  • Disclosure: All video and image content produced on this platform is AI-generated. We are committed to clearly labelling AI-generated content where required by law.
  • Human oversight: Our trust and safety team reviews flagged content and moderation decisions. Automated decisions that affect your account (e.g., suspension) can be escalated for human review.
  • No high-risk AI use: Our AI systems are not used for hiring, credit scoring, law enforcement, or other high-risk applications as defined under the EU AI Act.

8. Intellectual Property of AI Outputs

AI-generated outputs produced using your inputs are owned by you, subject to the licence you grant us under our Terms of Service. You are responsible for ensuring that your use of AI outputs complies with applicable intellectual property laws. SpicyGen AI makes no warranties regarding the copyright status of generated outputs.

9. Third-Party AI Providers

Our Service relies on third-party AI model providers to generate content. These providers operate under their own terms of service and acceptable use policies. We select providers that align with our content safety standards, but we are not responsible for the underlying model behaviour beyond what we control through our own moderation layers.

10. Reporting AI Misuse

If you believe our AI systems have been used to create harmful, illegal, or non-consensual content, please report it immediately:

  • Use the in-platform report feature available on all generated content.

We aim to respond to all reports within 24 hours. We will remove confirmed harmful content immediately and report illegal content to the appropriate authorities.

11. Changes to This Policy

We may update this AI Policy as our technology evolves and as laws and regulations change. Material changes will be communicated via email or a notice on our platform. Continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
