SpicyGen AI ("we," "our," or "us") operates an adult content platform. Access to our Service is strictly restricted to individuals aged 18 or over. This Age Verification Policy explains the measures we take to verify user age, why we do so, what data is collected during verification, and your rights in connection with that data.

2. Why We Verify Age

Age verification is a legal and ethical requirement for platforms that host or enable the creation of adult content. Our obligations include:

3. Our Age Verification Procedure

We use a layered approach to age verification:

3.1 Entry Gate (All Visitors)

Before any content is displayed, all visitors to SpicyGen AI are presented with an age verification gate. This gate requires the visitor to confirm they are 18 years of age or older before proceeding. Users who do not confirm their age are denied access to the platform.

3.2 Registration Confirmation

During account registration and login, users are required to actively confirm that they are at least 18 years old by checking a mandatory age confirmation checkbox. By completing registration, users legally represent and warrant that they meet the minimum age requirement.

3.3 Third-Party Age Verification (VerifyMy)

For enhanced age assurance, we integrate with VerifyMy, a certified third-party age verification provider. Where required by law or triggered by our risk-based systems, users may be directed to complete an independent age verification check via VerifyMy before accessing certain features.

VerifyMy operates its own privacy policy and data processing practices. Age verification via VerifyMy may involve providing proof of age through one or more of the following methods:

• Government-issued ID verification.
• Credit card or financial account check.
• Mobile network operator data.
• Digital identity or facial age estimation technology.

SpicyGen AI does not receive or store the underlying identity documents or biometric data submitted to VerifyMy. We only receive a pass/fail age verification result.

4. Data Collected During Age Verification

4.1 Data We Hold

• A record of whether you have confirmed your age (boolean pass/fail).
• The date and time of your age confirmation.
• Your IP address and device information at the time of confirmation, for audit and compliance purposes.

4.2 Data We Do Not Hold

• We do not store copies of identity documents.
• We do not store biometric data collected by VerifyMy.
• We do not receive your date of birth or exact age from VerifyMy — only confirmation that you meet the minimum age threshold.

All data is processed in accordance with our Privacy Policy, including your rights under GDPR and other applicable data protection laws.

5. Cookies and Age Verification

We use a strictly necessary cookie to remember that you have completed the age verification gate during your session. This cookie does not track your browsing activity and cannot be used to identify you. It expires at the end of your session or after a set period. For more information, see our Cookie Policy.

6. False Age Declaration

Providing a false declaration of age to access our Service is a violation of our Terms of Service and may constitute a criminal offence under applicable law. Any account found to belong to a minor will be immediately terminated and all associated content permanently deleted.

7. Parental Controls

We strongly encourage parents and guardians to use parental control software and internet filtering tools to prevent minors from accessing adult content online. Age verification is one layer of protection, but parental supervision and filtering tools provide additional safeguards.

8. Regulatory Compliance

Our age verification procedures are designed to comply with:

• Cyprus Radio Television Authority (RTA / ERGA) — Cyprus is an EU member state subject to the AVMSD as implemented in Cyprus. The Radio Television Authority of Cyprus oversees compliance for video-sharing platforms.
• EU Audio-Visual Media Services Directive (AVMSD 2018/1808) — effective age verification for video-sharing platforms with adult content, as transposed into Cyprus law.
• UK Online Safety Act 2023 — robust age assurance for platforms accessible to UK users.
• 18 U.S.C. § 2257 — US record-keeping requirements for producers of sexually explicit content (see our 2257 Exemption Statement).
• GDPR / Cyprus Law 125(I)/2018 — lawful processing of personal data in connection with age verification, supervised by the Commissioner for Personal Data Protection (Cyprus).

9. Changes to This Policy

We may update this Age Verification Policy as laws and our procedures evolve. Material changes will be communicated via email or a platform notice. Continued use of the Service after changes are posted constitutes your acceptance of the updated policy.
