Refund Policy

1. Overview

SpicyGen AI ("we," "our," or "us") operates a credit-based service. Credits are purchased and consumed to generate AI videos. Because each generation incurs immediate GPU processing costs, all purchases are generally non-refundable. However, we are committed to customer satisfaction and will work with you to resolve legitimate issues.

This policy applies to all credit purchases made on SpicyGen AI. It forms part of our Terms of Service.

2. Non-Refundable Situations

The following are not eligible for refunds:

  • Credits that have been fully or partially consumed through video generation.
  • Dissatisfaction with the artistic quality or style of AI-generated outputs (results vary by nature of generative AI).
  • Purchases where you changed your mind after completing the transaction.
  • Content that is rejected by our moderation system. Our content rules are clearly set out before purchase. If uploaded content cannot pass our moderation checks (e.g., it depicts a real person, minor, or prohibited subject), any credits consumed during the moderation or generation attempt are non-refundable.
  • Account terminations resulting from a violation of our Terms of Service or Trust & Safety policies.

3. Eligible Refund Situations

We will consider a refund or credit adjustment in the following circumstances:

  • Technical failure: A generation failed due to a platform error on our side and no output was delivered, yet credits were deducted.
  • Duplicate charge: You were charged more than once for the same purchase due to a payment processing error.
  • Unauthorised transaction: A purchase was made on your account without your authorisation (you must also report this to your card issuer).
  • Service unavailability: The Service was unavailable for an extended period and credits purchased for a specific purpose could not be used.

4. How to Request a Refund

To request a refund, please contact our support team before initiating any payment dispute or chargeback with your bank:

Please include the following in your request:

  • Your registered email address.
  • The date and approximate amount of the purchase.
  • A description of the issue experienced.
  • Any relevant screenshots or error messages.

We aim to respond to all refund requests within 3 business days.

5. Refund Method

Approved refunds will be returned to the original payment method. Refund processing times vary depending on your card issuer or payment provider, typically 5–10 business days. Where a refund to the original payment method is not possible, we may issue equivalent credits to your account at our discretion.

6. Chargeback Policy

Initiating a chargeback or payment dispute with your bank or card issuer without first contacting us is a violation of our Terms of Service. We maintain detailed transaction and usage logs and will provide evidence to contest illegitimate chargebacks.

Accounts that initiate chargebacks without prior contact may be immediately suspended. If a chargeback is found to be fraudulent, we reserve the right to pursue recovery of the funds and associated costs. See our Anti-Fraud Policy for more details.

7. EU / EEA and Cyprus Consumer Rights

As a company incorporated in the Republic of Cyprus, we are bound by Cyprus consumer protection law, including the Cyprus Consumer Protection Law (Law 133(I)/2021) which implements EU Directive 2019/771, and the EU Consumer Rights Directive 2011/83/EU.

If you are a consumer, you may have a statutory 14-day right of withdrawal for digital content purchases under Article 16(m) of the EU Consumer Rights Directive. However, by proceeding with a credit purchase and initiating the generation of AI content, you expressly consent to the immediate supply of digital content and acknowledge that your right of withdrawal is waived once delivery of the digital content has begun.

8. Changes to This Policy

We may update this Refund Policy from time to time. Material changes will be communicated via email or a platform notice. Continued use of the Service after changes are posted constitutes your acceptance.
